This Agreement, as negotiated herein, is entered into by and between ______________________________, hereafter referred to as “Renter(s)” and Focal Audio & Design, hereafter referred to as “Rental Provider.”

Whereas, the Rental Provider is a service provider of good standing; Whereas, the Renter wishes to lease property owned or under the jurisdiction of the Rental Provider as described more fully herein; and Whereas, the Rental Provider wishes to lease such property; therefore, in consideration of the foregoing premises and the mutual covenants hereinafter described, the parties agree as follows:

DURATION OF RENTAL AGREEMENT

In addition to the terms and conditions negotiated by the parties for particular leases of equipment, the Rental Provider and Renter hereby agree that the terms and conditions of this Rental Agreement (the “Agreement”) shall apply whenever the Rental Provider leases property to the Renter.

RENTER QUALIFICATIONS

-Renters must be at least 18 years of age have a Valid Driver’s License
-Renters must be in good standing with the Rental Provider—i.e. no outstanding balances, history of equipment damages or late returns, or falsified documents.

RESERVATION & QUALITY ASSURANCE

-The Rental Provider cannot guarantee that all equipment listed on www.focalaudiodesign.com will be available at the time of the Renter’s inquiry. Equipment will be leased as it becomes available.
-All rates subject to change without notice.
-First time renters agree to a 50% reservation deposit (unless otherwise stipulated). Payment can be made with Visa, MasterCard, Cash, or Check (bounced checks result in a $25 fee)
-Reservation of rental equipment is confirmed upon payment of deposit AND signed Lease Agreement.
-Reservations cancelled--in full or in part--less than fourteen (14) days prior to delivery date are subject to charge for the original total amount of the Lease Agreement.
-Rental equipment has been tested prior to delivery and leaves the Rental Provider in working order.
-Upon delivery, if equipment is deemed non-operational and a satisfactory replacement cannot be supplied within 4 hours, a refund for the item’s leased amount will be issued by the Rental Provider within 15 business days.

DELIVERY

-The Renter must provide a confirmed delivery address, delivery time, and contact information for delivery location.
-The Renter agrees to meet the Rental Provider at the time of delivery. NO ONE but the Renter can accept the leased equipment (unless the Rental Provider is notified at least 24 hours before delivery and provided with ID information for the delivery contact person).
-Renter agrees to pay remaining lease balance at the time of Delivery. Payment can be made with Visa, MasterCard, Cash, or Check (bounced checks result in a $25 fee)
-The Renter is responsible for understanding how to properly transport, set-up, operate and strike the leased equipment.
-The Rental Provider offers training for proper equipment operation for an additional consultation fee. Consultation services should be reserved at least seven (7) days prior to delivery.

PICK UP

-Pick-up of rental equipment will take place no later than 4:00 PM on the final date of lease. Time of pick-up is subject to the convenience of the Rental Provider. Late pick-up due to continued usage or improper packing of equipment is subject to an extra charge (a single day rental fee per item will be added per day overdue—with fees not exceeding 80% of item’s MSRP)*
-At the time of pick-up, to insure you have no additional fees simply respect the equipment and have it:

  • Clean
  • Functional
  • Properly stored

-A $5 fee will be charged for any tangled, unwound, wet, or dirty cables. Rental equipment that is damaged or missing will be subject to a charge (up to, but not exceeding, 80% of the item’s MSRP). The Rental Provider reserves the right to evaluate damaged equipment and to assess repair/ replacement charges. Any loss or damage rental equipment is the responsibility of the Renter.
*Exceptions made for late pick-up when a schedule conflict delays the Rental Provider.

PAYMENT

-The Renter agrees to pay the total balance of lease agreement(s) issued by the Rental Provider and signed by the Renter. Payment of outstanding balance (total lease amount minus reservation deposit) is due upon delivery of rental equipment. Rental Equipment will not be released to the Renter until outstanding balance is received.

  • First time Renters agree to a 50% payment upon reservation of equipment AND 50% payment at the time of delivery.
  • Returning Renters agree to pay 100% at the time of delivery (unless otherwise stipulated by the Rental Provider).

The Renter and Rental Provider are independent parties and nothing in this Agreement shall constitute either party as the employer, principal or partner of or joint venture with the other party. Neither the Renter nor Rental Provider has any authority to assume or create any obligation or liability, either express or implied, on behalf of the other.

This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon applicable therein.
